1. Agreement to Terms

By accessing or using Hardcopy ("the Service"), operated by Hardcopy ("we," "us," or "our") at tryhardcopy.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Hardcopy is a letter writing and physical mailing service. Our platform allows you to:

Write beautiful letters with rich text and inline photos using our digital editor
Choose from professionally designed templates for various occasions
Have your letters printed on premium paper stocks (Standard, Premium, Linen, or Cotton) and mailed to recipients via USPS
Manage an address book of mailing recipients
Keep a personal archive of letters you have written
Track the delivery status of mailed letters

No digital sharing: Hardcopy is designed for physical letter delivery only. We do not provide digital sharing, social posting, or public publishing of your letters. Your letters are personal and confidential.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized use of your account
Be responsible for all activities that occur under your account

You must be at least 13 years old to create an account. If you are under 18, you must have parental consent.

4. User Content

4.1 Ownership

You retain all ownership rights to the content you create ("User Content"), including letter text, photos, and any other materials. By using the Service, you grant us a limited, non-exclusive license to store, process, render, print, and transmit your content solely for the purpose of providing the Service.

4.2 Content Restrictions

You agree not to create content that:

Infringes on intellectual property rights of others
Contains illegal material or promotes illegal activities
Is defamatory, harassing, threatening, or constitutes hate speech
Violates the privacy rights of others without consent
Contains malware, viruses, or other harmful code

4.3 Content After Printing

Once a letter has been printed and mailed, we do not retain the physical copy. Our print partner deletes your letter data after printing is complete. A digital copy of your letter remains in your Hardcopy account for your personal records. We do not share, publish, or distribute your letter content in any form.

5. Orders and Payments

5.1 Pricing

All prices are displayed in US dollars and are subject to change. We will honor the price displayed at the time of your order. Pricing varies based on paper stock selection:

Standard — $3.99
Premium — $4.99
Linen — $5.99
Cotton — $7.99

5.2 Payment Processing

Payments are processed securely by Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your full payment card details.

5.3 Printing and Shipping

Letters are printed by our third-party print partner (Lob.com) and mailed via USPS. Delivery times vary based on destination but typically take 3-7 business days within the US. We are not responsible for delays caused by postal carriers, incorrect addresses provided by you, or force majeure events.

5.4 Refunds

Due to the personalized nature of our products, refunds are generally not available once an order has been submitted for printing. If you receive a defective print (e.g., misprinted text, damaged paper), please contact us within 14 days of receipt for a reprint at no charge.

6. Intellectual Property

The Service, including its design, templates, features, writing prompts, and branding (excluding User Content), is owned by Hardcopy and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARDCOPY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.

Our total liability for any claims arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time. Upon deletion, your personal data (including letters, addresses, and photos) will be permanently removed within 30 days.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
